Sub-Contractor Damages Policy

Charnwood Flooring does not accept liability for any accidental damage that may occur during the installation of flooring in commercial or residential properties. All sub-contractors engaged by Charnwood Flooring are expressly informed that they bare sole responsibility for overseeing and executing the installation process.

As the designated sales division for a range of manufacturers, we ensure that sub-contractors are fully notified that all assigned tasks must be conducted with the highest level of diligence and accountability. In the event of accidental damage or incorrect installations, sub-contractors are required to address the matter directly with the customer, negotiate a resolution, and undertake any necessary remedial actions in a courteously prompt and efficient manner.

We respectfully request that all parties acknowledge and adhere to these terms to ensure a mutual understanding of roles and responsibilities.

If Charnwood Flooring does not accept liability, who ensures that damages are properly resolved?

All sub‑contractors engaged by Charnwood Flooring bear sole responsibility for the installation process. In the event of accidental damage or incorrect installations, they are required to address the matter directly with you, negotiate a resolution, and carry out any necessary remedial actions promptly.

What happens if a sub‑contractor refuses to take responsibility for damage?

Sub‑contractors are expressly informed that refusal to resolve damage is a breach of their obligations. Customers should document the issue and notify the sub‑contractor immediately. If difficulties persist, Charnwood Flooring can assist by reminding the sub‑contractor of their expected duties, but the responsibility remains with the contractor.

Is there any guarantee that my property will be protected during installation?

While every sub‑contractor is expected to exercise the highest diligence, accidents can occur. The guarantee lies in the obligation that sub‑contractors must resolve any damage efficiently and professionally.

How quickly are sub‑contractors expected to respond to accidental damage?

Sub‑contractors are required to act promptly and courteously. While exact timelines may vary, customers should expect initial contact within a few working days and resolution without undue delay.

What steps should I take if I notice damage after installation is complete?

Notify the sub‑contractor directly, providing photographs and a clear description of the issue. This ensures a documented record and allows them to respond appropriately.

Will Charnwood Flooring assist me if the sub‑contractor does not respond promptly?

Yes. While liability rests with the sub‑contractor, Charnwood Flooring will support customers by reinforcing expectations and reminding sub‑contractors of their obligations but we would not be held financially responsible.

If repairs are needed, who covers the cost initially?

The sub‑contractor is responsible for covering the cost of repairs or replacements.

Can repair costs be deducted from the sub‑contractor’s payment, or will I need to pay upfront?

Sub‑contractors are expected to resolve the matter directly with you. In cases of non‑compliance, Charnwood Flooring may deduct costs from their CPS (Contractor Profit Scheme) payment only, ensuring customers are not unfairly burdened and those such payments be taken into fair consideration in the overall matter as a gesture of good will on part of Charnwood Flooring and potentially be awarded to the customer. This is only applicable if a CPS payment has not already been made.

Is insurance available or recommended to cover accidental damage?

Many sub‑contractors carry their own insurance which may be a route they choose to opt for but this is entirely up to them.

How is “courteous and efficient” service enforced in practice?

Sub‑contractors are expected to uphold professional standards. Failure to act courteously or efficiently may result in disciplinary measures, including removal from future projects.

What if the contractor is no longer in business?

Customers are encouraged to check their property insurance policies, which may cover accidental damage or incorrect intallations caused by contractors.

Would Charnwood Flooring assign another contractor?

Only if the original contractor is no longer in business. However this would incur costs for a new contractor to visit any such remedial works (Charnwood Flooring does not assume liability).

Does Charnwood Flooring offer any guarantees?

Charnwood Flooring only provides product manufacturer guarantees through the product manufacturer's own product guarantee. Charnwood Flooring is only a sales division of any such manufacturer and is not therefore obligated to product warranties or product installation warranties.
